The Incident
On Friday, May 12, at approximately 8:00 p.m., A Worcester Police officer working out of the Operations Division was on routine patrol in the Merrifield Street area. At this time the officer was traveling on Merrifield Street, heading towards Prospect Street, when he saw a gray Honda drive through the stop sign at the intersection of Merrifield and east Shelby Streets. The officer activated his emergency lights and signaled the driver of the Honda to stop.
The officer approached the driver’s door and asked the him for his license and registration. The driver appeared nervous to the officer. The officer noticed that the driver hands were shaking and he was stuttering his words. The driver stated that he did not have his license but did hand him his United States passport. The driver also failed to produce the car’s registration as asked by the officer.
At this time the officer asked the driver to exit the car. The driver was searched for weapons. During the pat frisk procedure, the driver pushed the officer away and began to run up Merrifield Street. The officer ran after the driver and tackled him to the ground. The driver was face down. The officer ordered him to place his hands behind his back while he remained face down. The driver refused all commands and proceeded to keep his hands under his body by his waistband. After several commands were ignored the officers began to fear that the driver may be trying to hide or reach for a weapon. The officers applied physical force to make the driver comply. The driver was placed in handcuffs and secured.
The officer continued to search the driver for weapons and/or contraband. After a thorough search the officer came upon a hard foreign object on the inside of his left shoe. The shoe was removed and the officer discovered a plastic baggie filled with several substances. There were two pills with markings that suggested it to be Oxycodone. The officer also discovered another individually wrapped baggie that contained heroin and another 5 baggies of crack cocaine. The officer also confiscated $298.00 in cash.
The money and narcotics were seized as evidence.
